This bill addresses waste incineration facilities by prohibiting local governments and the Department of Environmental Protection from issuing construction permits for new solid waste disposal facilities or waste-to-energy facilities that would be located within one-half mile of residential properties or schools, as measured from the facility's stack. The bill does not apply to existing facilities or modifications to structures in operation as of July 1, 2025. Additionally, the legislation makes several technical amendments to Florida Statutes, including updating cross-references and reordering subsections in sections related to solid waste management. The bill also maintains provisions for recycling credits for renewable energy facilities using solid waste as fuel, allowing counties to receive credit for energy production and providing some flexibility in achieving recycling goals. Municipalities and counties are still authorized to charge disposal fees that can vary based on recyclable materials present in waste, and the state will continue to evaluate and report on solid waste recycling efforts. The changes are designed to provide environmental protections by limiting the placement of new waste incineration facilities near residential areas and schools while maintaining existing waste management infrastructure and recycling initiatives.
