This bill amends Georgia's Code Section 5-3-10 to modify the rules for service of process (the formal delivery of legal documents to a party in a legal proceeding). The bill expands the methods of service to explicitly include certified mail and statutory overnight delivery with return receipt requested, in addition to personal service and electronic service. The changes allow service to be perfected either before or after filing with the court clerk, and when service is made by certified mail or statutory overnight delivery, it is considered complete on the day the documents are deposited in the mail. Additionally, when using these mailing methods, three extra days are added to any response deadline to account for mailing time. The bill also updates the certification language for proof of service, requiring parties to specify the number of copies delivered, the method of delivery, and the date of delivery. If a party's address is unknown and they are not represented by an attorney, service can still be attempted by certified mail or statutory overnight delivery to their last known address.
