The bill also limits the ability of those authorized to enter the land (such as oil and gas operators) to prevent the surface estate owner from accessing their own land, except when necessary to prevent public health risks. Additionally, the bill provides liability protections for surface estate owners, making them immune from civil liability for actions taken by the Commission or other authorized persons in the process of plugging or replugging wells. These provisions aim to balance the rights of surface estate owners with the regulatory needs of well plugging and abandonment, ensuring that landowners are not unduly burdened or prevented from using their property during and after well plugging operations. The bill will take effect on September 1, 2025, and will apply only to wells plugged or replugged on or after that date.
