This bill requires the Administrator of the Division of Industrial Relations to establish regulations to protect outdoor workers from poor air quality caused by wildfire smoke. The regulations will mandate that employers take specific measures when the air quality index (AQI) reaches 150 or higher, including monitoring air quality, reducing employee exposure, and prohibiting outdoor critical tasks at certain AQI levels. Employers must create a communication system that informs employees about air quality risks, allows workers to report exposure and symptoms, and provides training about air quality hazards and personal protection equipment. The bill defines "outdoors" as work environments directly affected by elements, and "wildfire smoke" as a complex mixture of gases and particles. Importantly, the regulations will not impose additional liability on employers for insurance purposes. The bill excludes certain employers from these requirements, such as mine operators, commercial truck drivers, emergency service providers, and businesses with 10 or fewer employees. The regulations will be developed with consideration for rural and remote working conditions, and will become fully effective on January 1, 2026, with initial preparatory work beginning upon passage and approval.
