This bill modifies Minnesota's existing law regarding fluoridation of public water supplies by giving local jurisdictions more discretion in deciding whether to fluoridate their water. The bill changes several key provisions: it allows water supply authorities (persons, firms, corporations, or municipalities) to choose whether to fluoridate their public water supply, removes the previous mandate for universal fluoridation by 1970, and explicitly prohibits the commissioner of health from requiring fluoridation. The bill maintains that if a public water supply opts to fluoridate, it must do so within fluoride content parameters established by the health commissioner. Additionally, the bill specifies that water supplies containing naturally occurring fluoride within the established parameters should not be additionally fluoridated. The commissioner of health is still required to create rules about fluoridation, including specifying fluoride content parameters, testing methods, and record-keeping requirements, but cannot mandate fluoridation. This change gives local water authorities more autonomy in managing their water supply's fluoride levels while maintaining regulatory oversight to ensure public health standards are met.
