Bill Summary

Under current law, all claims for improving farm-to-market roads must be paid from the farm-to-market road fund and charged to the allotment of the fund for the county in which the project is located. Partial payments may be made on work in progress, and a partial payment is not deemed final acceptance of the work or a waiver of any defect in the work. The board of supervisors of a county, the county engineer, or the department of transportation (DOT) may approve claims. This bill specifies that the board of supervisors of a county, the county engineer, or the DOT may approve partial and final claims for partial payments made during construction of a farm-to-market road.
