This bill modifies New York State's vehicle and traffic law to require first-time offenders convicted of alcohol or drug-related traffic offenses to participate in an alcohol and drug rehabilitation program. Specifically, when a court sentences a defendant for a first-time alcohol or drug-related driving offense (such as driving while intoxicated), the court must mandate that the defendant pay for and attend a rehabilitation program, provided they meet the program's eligibility criteria. The bill expands existing law by explicitly requiring court-mandated program participation for eligible first-time offenders, rather than making it optional. The rehabilitation program is designed to help prevent repeat offenses by providing education and treatment. The judge retains some discretion to prohibit program enrollment for good cause, and the program administrator can also reject participants at their discretion. Additionally, individuals who have participated in a similar program within the past five years or have prior convictions for certain alcohol-related driving offenses would not be eligible. The bill will take effect on the first of November following its passage into law.
