Bill Summary

AN ACT relating to interscholastic activities; requiring the Nevada Interscholastic Activities Association to adopt regulations setting forth the process by which a pupil who transfers schools may appeal a determination of eligibility to participate in any sanctioned sport or other interscholastic activity or event at the school under certain circumstances; requiring that any regulations adopted by the Nevada Interscholastic Activities Association relating to the eligibility to participate in any sanctioned sport or other interscholastic activity or event at the school to which the pupil transfers authorize a pupil to demonstrate a hardship by providing certain evidence; and providing other matters properly relating thereto.

AI Summary

This bill modifies regulations for the Nevada Interscholastic Activities Association (NIAA) regarding student transfers and participation in interscholastic sports and activities. The bill requires the NIAA to establish a formal appeal process for students who have been deemed ineligible to participate in sports or activities at a new school due to a transfer. Specifically, the bill introduces a "hardship" provision that allows students to demonstrate they transferred schools due to emotional distress, which can be proven through documentation such as an affidavit from the student or written testimony from a licensed physician or mental health professional. The bill defines "hardship" as an unusual circumstance beyond the normal control of the student or their parent/guardian that is unrelated to sports participation. By creating this appeal mechanism, the legislation aims to provide more flexibility for students who change schools and potentially face barriers to participating in interscholastic activities. The bill ensures that transfer eligibility rules apply equally to public and private schools that are members of the NIAA and maintains existing provisions for military family children, who remain immediately eligible to participate in sports and activities upon transferring schools.
