This bill directs the New York Department of Health to create a new alternative payment methodology (APM) specifically for federally qualified health centers (FQHCs) to support patient access to fertility care. The APM will provide additional payments to eligible FQHCs for specific fertility drugs (specifically gondotropion, GNRH antagonists, and GNRH agonists) during the calendar year 2024. The payment will be calculated by determining the difference between what the FQHC would have been paid for these drugs under section 340B of the federal Public Health Services Act and the amount the provider would have been reimbursed by a managed care organization. These payments are intended to be supplemental to any existing prospective payment system (PPS) or other alternative payment methodologies already in place for FQHCs. The bill is designed to help preserve and improve patient access to fertility treatments by providing financial support to health centers offering these services. The act is set to take effect immediately upon passage.
