This bill modifies two existing state funds related to school district capital improvements: the Fund to Assist School Districts in Financing Capital Improvements and the Fund to Assist Rural School Districts in Financing Capital Improvements. Specifically, the bill ensures that any unspent money in these funds at the end of a fiscal year will not revert to the State General Fund but instead will be carried forward to the next fiscal year. Additionally, the bill expands grant opportunities for rural school districts (those in counties with fewer than 100,000 residents) by allowing them to apply for grants from the Rural School Districts Fund when they receive gifts, grants, or donations for capital projects located on qualified tribal land, or when they accrue interest on such project funds. "Qualified tribal land" is defined as real property owned or held in trust for an Indian tribe or Native American, subject to federal alienation restrictions, and over which an Indian tribe exercises governmental power. This change provides more financial flexibility for rural school districts, particularly those with capital projects on tribal lands, by creating an additional avenue for funding beyond traditional tax-based grants.
