This bill amends the Texas Business & Commerce Code to provide clarity on the use of biometric identifiers in artificial intelligence (AI) applications. The bill defines AI as the use of machine learning technologies that enable computer systems to perform tasks typically associated with human intelligence, such as computer vision, speech processing, and content generation. It also clarifies that a biometric identifier includes retina or iris scans, fingerprints, voiceprints, and records of hand or face geometry. The key provision establishes that these regulations do not apply to AI technologies used for general purposes, but only when they are specifically aimed at uniquely identifying an individual. Additionally, if a biometric identifier collected for AI purposes is subsequently used for a different commercial purpose, the entity possessing the identifier will be subject to existing legal provisions regarding biometric identifier possession, destruction, and associated penalties. The bill is set to take effect on September 1, 2025, giving businesses and technology companies time to prepare for and adapt to the new regulations.
