This bill amends the Human Resources Code to provide two key forms of legal expense support for Department of Family and Protective Services (DFPS) employees. First, the bill maintains existing provisions that allow the department to indemnify (reimburse) present or former employees up to $10,000 for attorney's fees if they are criminally prosecuted for actions related to protecting children, elderly persons, or persons with disabilities, and are ultimately found not guilty or have their case dismissed. Second, the bill introduces a new provision allowing the department to reimburse current DFPS employees up to $5,000 for reasonable attorney's fees incurred while obtaining a protective or restraining order in the course of their employment. The bill requires DFPS to adopt rules implementing this new reimbursement provision and will take effect on September 1, 2025. This legislation appears designed to provide legal and financial support for DFPS employees who may face legal challenges while performing their protective services duties.
