Bill Summary

AN ACT relating to allowing Medicaid managed care organizations to engage in marketing about the availability of certain private health benefit plan coverage.

AI Summary

This bill allows Medicaid managed care organizations (MCOs) more flexibility in marketing health insurance options by permitting them to: (1) inform current or former Medicaid recipients about qualified health plans available through health insurance exchanges, which are online marketplaces established under the Affordable Care Act where individuals can compare and purchase health insurance; and (2) advertise Medicare Advantage plans (private health insurance plans that contract with Medicare to provide Part C benefits) at community enrollment events or similar gatherings. Currently, marketing guidelines may restrict such communications, but this bill would explicitly remove those prohibitions, giving MCOs broader ability to inform individuals about alternative health coverage options. The bill is set to take effect on September 1, 2025, and includes a provision that if any federal agency waiver is required for implementation, the state agency can delay implementation until such authorization is granted.
