This joint resolution requests the Legislative Council to designate an interim committee or direct staff resources to conduct a comprehensive study of the Uniform Common Interest Ownership Act (UCIOA), which was previously introduced as House Bill No. 619 during the 69th Legislature. The study aims to review and analyze the UCIOA, examine current Montana laws governing owners' associations and condominiums, including those in Title 35, chapter 2 (nonprofit organizations) and Title 70, chapter 23 (Unit Ownership Act), and determine if legislative changes are necessary. The resolution mandates that the study include representatives from various industry groups such as the Montana Bankers Association, Montana Land Title Association, and Montana Association of Realtors. If the study is assigned to staff, any findings must be presented to and reviewed by an appropriate committee designated by the Legislative Council. The study must be completed by September 15, 2026, with final results and recommendations to be reported to the 70th Legislature. This resolution is motivated by the need to update laws governing owners' associations and condominiums, which have not been substantially amended since 1965 and have not kept pace with changes in banking, insurance, title, real estate, and development industries.
