This bill requires state employees operating state-owned vehicles to provide a urine specimen for alcohol and drug testing if they are involved in a motor vehicle accident that results in serious injury or death, and if there is probable cause to believe they were operating the vehicle under the influence of alcohol or drugs, as defined by specific sections of Iowa law (321J.2 or 321J.2A). "Serious injury" is defined as it is in section 702.18 of the law. The specimen must be provided to a peace officer within two hours of the accident, and the analysis will be conducted according to chapter 321J, which outlines procedures for alcohol and drug testing. The employee has the right to obtain an independent analysis of the specimen at their own expense, and the results of the state-administered analysis will be made available to them, though their inability to get an independent test does not prevent the state's results from being used as evidence. This requirement does not apply if a blood, breath, or urine specimen is already collected under chapter 321J.
