This bill modifies the annual permit fee for video lottery terminals in West Virginia by introducing a tiered fee structure based on terminal performance. Currently, licensees pay a flat $1,000 annual fee per video lottery terminal. Under the new legislation, if a terminal's software version outperforms the 10% lowest performing software versions of similar terminals by more than $900 in annual net terminal income, the permit holder will pay a reduced fee of $100 per terminal, instead of the standard $1,000. The West Virginia Lottery will calculate this performance metric by analyzing daily net terminal income from March 1st of the preceding year to the last day of February, and will prepare a report identifying the lowest-performing software versions and eligible permit holders for the reduced fee. A terminal must be active and operational for at least 60 days to qualify for the reduced fee. This new fee structure will be in effect from May 1, 2025, until May 1, 2030, and aims to incentivize and reward higher-performing video lottery terminals in the state.
