Bill Summary
AN ACT to amend the executive law, in relation to the development of a critical incident policy for members of the division of state police
AI Summary
This bill requires the superintendent of the state police to develop and implement a critical incident leave policy for state police officers involved in serious incidents involving the use of force. The policy defines a "critical incident" as an action during official duties resulting in serious physical injury or death where force was justified. The bill mandates paid leave of at least 20 calendar days for officers directly causing such an incident, and 15 calendar days for officers involved but not directly causing the injury or death. The superintendent can delay leave only to maintain minimum staffing levels or protect community safety, and must ensure such delays are as short as possible. The bill also prohibits the superintendent from taking punitive administrative action against an officer solely based on receiving critical incident leave. If it is later determined that a critical incident did not actually occur, the superintendent may withhold future paid leave, but not more than the original leave days granted. The law will take effect 120 days after becoming law, with immediate authorization for developing necessary regulations.
