Bill Summary

This bill provides that only the general assembly has the power to alter the period of time a civil action may be brought under Code section 614.1 (limitations of actions —— period). Code section 614.1, governs time limitations for the following civil actions: (1) an action involving penalties or forfeitures under an ordinance; (2) an action involving injuries to person or reputation or for a statute penalty; (3) an action with respect to products resulting in injuries or death; (4) an action against a sheriff or other public officer; (5) an action arising from unwritten contracts, injuries to property, fraud, and other causes of this respect; (6) an action arising from written contracts, judgments of courts not of record and recovery of real property and rent; (7) a judgment of courts of record; (8) a judgment quieting title; (9) an action arising from a wage dispute; (10) an action arising from a malpractice claim; (11) an action arising from a secured interest in farm products; (12) an action arising from improvements to real property; (13) an action arising from a claim of sexual abuse or sexual exploitation by a counselor, therapist, school employee, or adult providing training or instruction; (14) an action founded on public bonds or obligations; and (15) an action brought by a county for collection of taxes.

AI Summary

This bill proposes a modification to Code section 614.1, which governs the time limitations for various civil actions in Iowa. Specifically, the bill adds language that explicitly states that only the general assembly (the state legislature) has the power to change or modify the time periods for bringing civil actions. The bill does not alter the existing time limitations themselves, but rather reinforces the legislature's exclusive authority to modify statutes of limitations. This means that no other governmental body or entity can unilaterally change the prescribed time frames within which different types of civil lawsuits must be filed, such as actions involving personal injuries, contract disputes, property claims, or other legal matters. By adding the phrase "provided that such time limitations may only be altered by an Act of the general assembly," the bill aims to clarify and preserve the legislative branch's sole jurisdiction over modifying these legal time restrictions.
