This bill amends the New York Real Property Law to specifically designate Kings County (Brooklyn) as a "cease and desist zone" and establishes a new legal defense for property owners facing violations of nonsolicitation orders. Under the bill, Kings County will be automatically included in the cease and desist list maintained by the secretary of state. The bill also creates an affirmative legal defense for property owners who have been accused of violating nonsolicitation orders or cease and desist zone regulations. Specifically, a property owner can avoid penalties if they can demonstrate that they publicly advertised the property for sale through methods such as real estate listings or advertisements. This means that even if a property is in a cease and desist zone, the owner won't be penalized for solicitation if they can show they were actively marketing the property. The bill will take effect 30 days after becoming law and will apply to all nonsolicitation orders issued on or after that date.
