This bill authorizes the town of Yorktown in Westchester County to install and operate photo speed violation monitoring systems in construction or maintenance work areas within its jurisdiction, with the exception of state highways. The bill, known as "Jake's Law," expands upon an existing state demonstration program that allows the state Department of Transportation to use automated speed cameras in highway work zones. Specifically, the town can now use these photo speed violation monitoring systems when highway work is occurring and either a specific work zone speed limit is in effect or other speed limits apply. The systems will capture images of vehicles exceeding the posted speed limit, and the owner of the vehicle can be held liable for the violation. The bill also makes technical amendments to the general municipal law to clarify the jurisdiction of traffic violations bureaus in adjudicating these types of speed violations. The law will take effect 90 days after becoming law, with provisions that ensure the amendments do not extend beyond the existing sunset provisions of the original law.
