This bill prohibits gaming entities licensed under the Racing, Pari-Mutuel Wagering and Breeding Law from limiting, banning, or restricting a player's betting primarily based on their success. The bill defines "success" as a player's ability to win or lose games through lawful means and allows licensed entities to implement win and loss caps, but with specific restrictions. Entities can set a win cap, which must be accompanied by a loss cap no greater than 2% of the win cap, and must strictly enforce these caps by prohibiting further play when a player exceeds them. Players have the option to voluntarily opt out of these caps by providing a signed, written notice before exceeding 50% of either cap, with the notice being valid for 168 hours or until rescinded. If a player opts out, the entity may then limit or ban them based on their success. The bill also provides a private right of action for players who are improperly limited or whose winnings or losses exceed the established caps, allowing them to seek compensation for the difference. The act will take effect 90 days after becoming law, providing gaming entities time to adjust their practices to comply with the new regulations.
