This bill amends the New York agriculture and markets law to expand the legal definition of aggravated cruelty to animals. Specifically, the bill adds two scenarios that would constitute aggravated cruelty: (a) intentionally killing or causing serious physical injury to a companion animal without justifiable purpose, and (b) recklessly engaging in conduct that creates a grave risk of serious physical injury or death to an animal, thereby actually causing serious physical injury or death. The bill maintains the existing definition of "aggravated cruelty" as conduct intended to cause extreme physical pain or done in an especially depraved or sadistic manner. The language has been updated to use more gender-neutral terminology, replacing "he or she" with "such person". The modifications aim to provide more comprehensive legal protection for animals by broadening the circumstances under which an individual can be charged with aggravated cruelty, particularly in cases demonstrating a reckless disregard for an animal's life. The bill would take effect immediately upon passage.
