This bill restricts the Texas Commission on Environmental Quality (TCEQ) from issuing new permits for direct discharges of waste or pollutants from domestic wastewater treatment facilities into specific stream segments and assessment units that meet certain water quality criteria. Specifically, the bill applies to stream segments or assessment units that have had at least 10 water quality samples taken over the 10 years preceding January 1, 2025, and have demonstrated total phosphorus levels below 0.06 milligrams per liter in 75% or more of those samples. The restrictions also extend to the drainage areas of these stream segments. However, the bill provides exceptions for permits issued to municipalities or river authorities, individual municipal storm sewer system permits, and general permits for stormwater discharges. The bill defines various technical terms such as "classified segment," "stream assessment unit," and "unclassified water body" to provide clarity. The new regulations will only apply to permit applications submitted to TCEQ on or after the bill's effective date, which will be either immediately upon receiving a two-thirds vote in the legislature or September 1, 2025, if the immediate effect vote is not achieved.
