Bill Summary
AN ACT to amend the executive law, in relation to law enforcement intervention against police misconduct
AI Summary
This bill establishes legal protections for law enforcement employees who intervene against police misconduct, defined as excessive force, false arrest, sexual misconduct, or witness tampering by another law enforcement officer. The bill applies to employees of state police, county sheriff's departments, and city, town, village, university, park, or public authority police departments. Under this legislation, a law enforcement employee who intervenes in good faith against police misconduct will receive immunity from civil and criminal liability for their actions. Additionally, the bill prohibits law enforcement agencies from taking retaliatory personnel actions against an employee who reasonably believes they needed to intervene against misconduct. This means that if an officer steps in to stop another officer from engaging in inappropriate or illegal behavior, they cannot be punished, sued, or face professional consequences for doing so. The bill aims to encourage accountability within law enforcement by protecting those who speak up or take action against wrongdoing by their colleagues.
