Bill Summary

This bill provides for authorized electronic monitoring in nursing facilities. The bill provides that a nursing facility resident or a resident representative, as applicable, may conduct electronic monitoring of the resident’s room through the use of electronic monitoring devices placed in the resident’s room pursuant to the bill. The bill specifies the consents that must be obtained for a resident to conduct electronic monitoring in the resident’s room, including from any roommate; the process to be followed if a roommate refuses to consent; the provision of notification to the nursing facility; the notification and consent form requirements; the responsibility for costs and installation relating to the electronic monitoring; notice to visitors; prohibited obstruction of electronic monitoring devices; immunity from liability, and licensee discipline; resident protections; and reporting requirements. The bill also directs the department of inspections and appeals to prescribe the notification and consent form described in the bill and to make the form available on the department’s internet site.

AI Summary

This bill establishes a comprehensive framework for electronic monitoring in nursing facilities, allowing residents or their representatives to use video cameras in residents' rooms under specific conditions. The bill defines electronic monitoring as a livestream video camera placement, excluding video calls, and provides detailed guidelines for consent, installation, and use. Residents or their legal representatives must complete a notification and consent form, which requires obtaining consent from roommates in shared rooms and includes provisions for accommodating residents who want to use electronic monitoring. The bill mandates that nursing facilities cannot refuse admission or retaliate against residents based on their electronic monitoring choices, and it requires facilities to post signs indicating the potential presence of monitoring devices. Residents are responsible for all costs associated with installation and maintenance, and the devices must comply with privacy restrictions, such as prohibiting audio recording and requiring the camera to be turned off during personal care activities. The bill also provides liability protections for nursing facilities that comply with the monitoring guidelines and requires facilities to report the number of monitoring consent forms received during their recertification surveys. Additionally, the bill directs the department of inspections and appeals to create and make available the required notification and consent forms.
