This bill establishes regulations for intermediate bulk container (IBC) recycling facilities in Texas, defining an IBC as a portable container between 275 and 1,000 gallons used for storing and transporting materials. The bill requires that such recycling facilities cannot be located within 2,000 feet of a private residence and mandates that facility owners register with the Texas Commission on Environmental Quality at least 30 days before beginning operations. The commission will be required to conduct on-site inspections of these facilities every three years to ensure compliance with environmental regulations. Facilities handling 50 or fewer IBCs at a time are exempt from these requirements. The bill also authorizes the commission to impose an annual registration fee sufficient to cover the administrative costs of the program, with these fees to be deposited into the water resource management account. Municipalities retain the authority to adopt even stricter ordinances prohibiting IBC recycling facilities near residential areas. The new regulations will apply to facilities beginning operations on or after the bill's effective date of September 1, 2025, with existing facilities having until March 31, 2027, to register. Implementation of the bill is contingent on specific legislative appropriations for this purpose.
