This bill modifies the existing Texas Education Code to expand the carrying options for school marshals across different educational institutions, including school districts, open-enrollment charter schools, private schools, and public junior colleges. The key change allows uniformed school marshals to openly carry handguns on school premises, in addition to the previously permitted concealed carry. Specifically, the bill provides that a school marshal, when wearing a uniform that identifies them as a school marshal, may openly carry a handgun on their person, in addition to the existing options of carrying a concealed handgun or storing the handgun in a locked and secured location. The bill maintains the existing requirement that handguns must be loaded only with frangible duty ammunition approved by the Texas Commission on Law Enforcement. These changes will apply beginning with the 2025-2026 school year, and the bill will take effect either immediately if it receives a two-thirds vote in the Texas Legislature, or on September 1, 2025, if it does not receive the immediate effect vote. The bill aims to provide school marshals with more flexibility in how they carry firearms while maintaining strict regulations around their use.
