This bill establishes new rules for maintaining Medicaid reimbursement for nursing facilities when they change ownership. Specifically, the bill requires the Texas Health and Human Services Commission to ensure that a nursing facility can continue receiving uninterrupted Medicaid payments after a change in ownership, provided certain conditions are met. These conditions include: being enrolled as a Medicare and Medicaid provider, satisfying state licensing and legal requirements, potentially assuming the previous contract, entering into a successor liability agreement, and meeting additional commission requirements. The successor liability agreement must obligate the new owner to pay any outstanding liabilities from the previous ownership, including those incurred before the ownership change and identified by the commission or a Medicaid managed care organization. The bill does not apply to supplemental or directed payment programs, and it will take effect on September 1, 2025. If any federal waivers or authorizations are needed to implement the bill, the relevant state agency can request them and delay implementation until they are granted.
