This bill establishes a framework for creating "broadband opportunity areas" to incentivize the expansion of high-speed internet infrastructure in underserved regions of New York. The bill allows the state's urban development division to designate census tracts as broadband opportunity areas if they currently lack adequate internet service, as defined by the Federal Communications Commission. Telecommunications service providers can receive property tax exemptions for constructing "last mile" broadband infrastructure (which means network infrastructure that connects directly to individual homes and businesses within 300 feet of the construction path) in these designated areas, provided they deliver internet speeds of at least 100 Mbps download and 20 Mbps upload. Municipal corporations can choose to adopt local laws granting these tax exemptions for up to ten years, but only after holding a public hearing. To qualify for the exemption, providers must file appropriate applications with local assessors, and the infrastructure must be newly constructed or significantly improved after the area's designation. The bill includes provisions for terminating a broadband opportunity area designation if a provider fails to implement its broadband plan, does not meet reporting requirements, or demonstrates inadequate management. Importantly, any existing exemptions will continue even if the area's designation is later terminated, ensuring ongoing support for internet infrastructure development in underserved communities.
