This bill creates two new driving offenses related to fatigue: driving while ability impaired by fatigue and aggravated driving while ability impaired by fatigue. The aggravated version of this offense occurs when driving while fatigued results in either serious physical injury (as defined in the penal law) or the death of another person. The bill aims to address the dangers of driving while extremely tired by creating legal consequences for individuals who continue to operate a vehicle when they are too fatigued to do so safely. The new law will take effect on the first of November following its passage, giving drivers and law enforcement time to become aware of the new regulations.
