AN ACT to amend the general business law, in relation to imposing liability for damages caused by a chatbot impersonating certain licensed professionals
AI Summary
This bill amends the general business law to hold operators of chatbots liable for damages caused when their AI systems impersonate licensed professionals, such as doctors, lawyers, or architects, by providing information or services that would be illegal if performed by a human in those professions. An "operator" is defined as the entity that owns, operates, or deploys the chatbot, and importantly, this liability cannot be avoided by simply informing users they are interacting with an AI. The bill requires operators to clearly and conspicuously notify users that they are interacting with an AI chatbot, with the notice being easily readable and no smaller than other text on the platform. The Attorney General is empowered to bring legal action against operators for violations, seeking civil penalties of up to $15,000 per day and other appropriate remedies, and will maintain a website for public complaints.
