This bill establishes a new Public Education Scholarship Program in Texas that allows eligible children to receive a scholarship equivalent to the maintenance and operations property tax paid for their primary residence or the full basic allotment, whichever is less. An eligible child is defined as a student who is school-age, meets specific requirements, and was previously enrolled in public school or is entering prekindergarten, kindergarten, or first grade in 2025. School districts must notify parents of eligible children about the scholarship at least 30 days before the school year begins. Parents must present proof of enrollment in an educational institution other than their zoned public school to the county tax office annually to receive the scholarship, which will be issued as a property tax refund within 30 days. The scholarship is tied to the individual child and cannot be transferred to another child in the same household. If a scholarship recipient later enrolls in a public school, the parent must repay a pro-rata portion of the scholarship. The bill would take effect immediately if it receives a two-thirds vote in the Texas Legislature, or on September 1, 2025, if it does not receive the immediate effect vote.
