This bill modifies Texas law regarding e-cigarette products by expanding the definition of "e-cigarette" to include consumable liquid solutions or materials used in electronic smoking devices, regardless of nicotine content. The bill prohibits marketing, advertising, selling, or offering for sale e-cigarette products with specific characteristics, including those: (1) featuring cartoon-like characters, celebrity images, or images resembling food products; (2) disguised as common items like school supplies, smartphones, clothing, or toys; (3) manufactured in China or countries designated as foreign adversaries by the U.S. Secretary of Commerce; and (4) containing or marketed as containing substances like cannabinoids, alcohol, kratom, or other specified compounds. The legislation increases the criminal penalty for violating these restrictions from a Class B to a Class A misdemeanor. The bill will take effect on September 1, 2025, and will only apply to offenses committed on or after that date. The legislature has also included a severability clause, ensuring that if any part of the law is found invalid, the remaining provisions will remain in effect.
