This bill modifies West Virginia's medical cannabis law by updating regulations around its possession, use, and dispensation. Specifically, the bill allows patients with a valid medical cannabis identification card and designated caregivers to possess and use medical cannabis in various forms, including pills, oils, topical treatments, vaporized forms, tinctures, liquids, dermal patches, and now explicitly adding "flowers of the plant" as a permissible form. The bill removes previous language prohibiting smoking of medical cannabis, effectively legalizing that method of consumption. Key restrictions remain in place, such as limiting caregivers to serving no more than five patients, patients being able to designate up to two caregivers, and requiring medical cannabis to be kept in its original dispensary packaging. The bill maintains that medical cannabis can only be grown and dispensed by authorized health care medical cannabis organizations with proper permits from the state bureau. Patients and caregivers must always carry their identification cards when possessing medical cannabis, and products must be labeled with specific information including the grower/processor name, dispensary name, cannabis form and species, and THC and cannabinol percentages.
