This concurrent resolution authorizes the Board of Land and Natural Resources (BLNR) to issue a perpetual, non-exclusive easement for drainage outlets located on state submerged lands at the Kahala Hotel and Resort in Waialae, Honolulu, Oahu. The easement covers approximately 12,700 square feet and will allow the hotel to continue using, repairing, and maintaining existing drainage improvements that were constructed before current Conservation District and Special Management Area laws were enacted. The resolution notes that Resorttrust Hawaii, LLC, which purchased the hotel in 2018, has been working with the Department of Land and Natural Resources to formalize the easement. Before the easement is finalized, the hotel must pay the state the fair market value of the easement, as determined by an independent appraisal approved by the BLNR Chairperson. This action is required under section 171-53 of Hawaii Revised Statutes, which mandates prior approval from the Governor and authorization from the Legislature for leasing state submerged lands.
