This bill modifies Texas' Penal Code to expand the definition of a machine gun and introduce a new category called a "machine gun conversion device," which is defined as any part or combination of parts intended to make a firearm capable of shooting more than one shot automatically with a single trigger pull. The bill changes the existing definition of a machine gun from being able to shoot more than two shots automatically to more than one shot automatically. It also adds machine gun conversion devices to the list of prohibited items that a person cannot intentionally or knowingly possess, manufacture, transport, repair, or sell, unless the item is registered in the National Firearms Registration and Transfer Record or classified as a curio or relic by the U.S. Department of Justice. The bill provides an affirmative defense for possession of a machine gun conversion device if it meets the registration or classification exceptions. The changes to the law will only apply to offenses committed on or after the bill's effective date of September 1, 2025, with previous offenses still governed by the law in effect at the time of the offense.
