This bill authorizes the Division of Environmental Quality to maintain a delinquent list of businesses that fail to pay wholesalers for petroleum products. Under the new law, a wholesaler can report a delinquent payment to the division within two business days of the payment being due, providing details such as the business name, address, sale date, amount owed, and wholesaler information. Once reported, the division will "red-tag" the delinquent business, preventing further petroleum product deliveries until the debt is paid. The business can only be removed from the list by paying the full amount due through approved payment methods like cash, electronic transfer, or cashier's check. If the business disputes the delinquency, they can file a written statement with the division explaining the reason for the dispute, and the wholesaler can also submit a response. The division will then review both statements and decide whether to remove the "red tag" from the business. This bill aims to provide a mechanism for petroleum wholesalers to address non-payment and protect their business interests.
