This bill establishes a New York brewery empowerment and economic revitalization tax credit that provides seven cents per gallon for beer produced in the state, with several key provisions. Breweries registered as distributors and subject to specific tax articles can qualify for this credit, with a maximum annual credit limit of five million dollars. To be eligible, breweries must pay their employees an average wage of at least 125% of the statewide average wage for brewery workers, as determined by the New York Department of Labor's quarterly census of employment and wages. The Department of Labor, in collaboration with tax authorities, will develop a methodology to verify brewery compliance and issue a certificate of tax credit within 180 days of publishing wage data. Importantly, breweries claiming this credit cannot simultaneously claim another existing tax credit for beer production. The credit can be applied against taxes in articles nine-A and twenty-two of the tax law, and if the credit amount exceeds a brewery's annual tax liability, the excess can be treated as an overpayment and potentially refunded, though no interest will be paid on such refunds.
