This bill modifies Section 10 of Chapter 6D of the Massachusetts General Laws to strengthen enforcement mechanisms for health care entities that fail to comply with certain administrative requirements. Specifically, the bill expands the circumstances under which the Health Care Cost Transparency and Oversight Commission can levy significant financial penalties against health care entities. The new provisions allow the commission to assess a $500,000 per day civil penalty if a health care entity: (1) fails to submit a required performance improvement plan within 45 days, (2) submits an unacceptable performance improvement plan, (3) does not implement the improvement plan in good faith, or (4) knowingly withholds or falsifies information requested by the commission. These penalties are intended to ensure health care entities are more accountable and transparent in addressing performance and cost issues, ultimately aiming to help control rising health care costs for consumers by creating stronger regulatory oversight.
