This bill establishes new liability insurance requirements for hotels, motels, and lodging facilities that contract with the Commonwealth to provide emergency housing assistance. Specifically, these facilities must maintain an active general liability and property damage insurance policy that covers damages caused by occupants placed through the emergency housing program. They are required to provide annual proof of insurance to the executive office before contract signing and renewal, and must assume full financial responsibility for any property damage, destruction, or loss caused by program occupants. The Commonwealth will not be financially responsible for such damages, including repair costs, replacement expenses, insurance deductibles, or lost revenue. Facilities must also submit timely damage reports to their insurance providers and seek reimbursement exclusively through their insurance policies. If facilities fail to maintain proper insurance or attempt to recover damage costs from the state, they may face contract termination, financial penalties determined by the executive office, and disqualification from future state housing contracts. The Executive Office of Housing and Livable Communities will be responsible for creating the rules and regulations to implement these new requirements.
