This bill introduces new provisions to Chapter 6A of the General Laws to allow certain minors, defined as "mature minors," to consent to supportive services when experiencing or at risk of experiencing homelessness. A mature minor is specifically defined as a person who is 15 years or older, not in the physical custody of a parent or legal guardian, lacks a fixed residence, or is at significant risk of homelessness, and can understand the implications of their situation. The bill allows such minors to consent to supportive services if a service provider reasonably believes the minor understands the benefits, risks, and requirements of the services, and that the services are necessary for their safety and wellbeing. The bill provides immunity from civil or criminal liability for service providers who follow these guidelines, except in cases of gross negligence. Supportive services are broadly defined to include interventions that help with stable housing, social connections, financial stability, education and employment, and social-emotional wellbeing. The bill also allows a mature minor who is a parent to consent to services for themselves and their child, and requires providers receiving state homeless youth services funding to obtain informed written consent from the minor, which must include their age, guardianship status, and living situation. The Office of Children, Youth, and Families will be responsible for adopting regulations to implement these provisions.
