This bill modifies existing Massachusetts law to create an appeals process for MBTA (Massachusetts Bay Transportation Authority) Communities that are struggling to comply with zoning requirements for housing development. Specifically, the bill allows municipalities to seek relief from zoning provisions if they can demonstrate significant challenges in five key areas: (1) insufficient drinking water supply to support required housing units, (2) inadequate wastewater treatment capacity, (3) municipal transportation infrastructure that cannot safely handle the population increase from new housing, (4) potential adverse environmental impacts from housing developments, and (5) negative effects on historical properties. The Department of Housing and Community Development will be responsible for developing and implementing this appeals process, which provides municipalities with a mechanism to request exemptions or modifications to housing development mandates if they can prove substantial practical barriers to implementation. This legislation aims to provide flexibility in housing development requirements while recognizing the unique challenges different communities may face in meeting state housing goals.
