This bill creates a voluntary do-not-sell firearms list administered by the Massachusetts Department of Criminal Justice Information Services, allowing individuals 18 years and older to voluntarily request registration that would prohibit them from purchasing, renting, leasing, borrowing, possessing, or carrying firearms. When a person registers, the department will notify the U.S. Attorney General to include them in the National Instant Criminal Background Check System (NICS), and the list will only be accessible to licensing authorities and the state police colonel. Individuals must apply in writing and provide a photocopy of a valid government-issued identification, such as a driver's license, state ID, passport, or military ID. The registration cannot be deregistered until 21 days after an application is submitted, and during the deregistration process, the department will notify the U.S. Attorney General and destroy all personal records. Importantly, information about list registration will be kept confidential and cannot be used in legal proceedings, employment decisions, or considered a public record. The department is also required to conduct a public awareness campaign about the list's availability.
