This bill requires property owners' associations (POAs) to electronically file certain documents with the Texas Real Estate Commission (TREC) within seven days of filing a management certificate or amended management certificate. Specifically, POAs must submit their organization's rules and regulations and their enforcement policy electronically to TREC, which will make these documents publicly accessible online. If a POA fails to file these documents, they will be subject to administrative penalties of $1,000 for the first day of violation and $500 for each additional day, with these penalties to be deposited as general revenue in the state treasury. POAs are explicitly prohibited from recouping these penalties from their members.
