This bill creates a comprehensive regulatory framework for the sale of over-the-counter medications containing pseudoephedrine (PSE) or ephedrine, which are commonly used in cold medicines but can also be used to illegally manufacture methamphetamine. The bill mandates that retailers use a real-time electronic stop sale system to track and limit PSE purchases, restricting individuals to 3.6 grams per day and 9 grams per 30-day period. Retailers must keep these products behind the counter, require valid government-issued photo identification for purchase, and record detailed transaction information including the purchaser's name, address, product details, and identification number. Starting January 1, 2026, retailers must electronically submit purchase information to a state-administered tracking system that can generate "stop sale" alerts to prevent purchases exceeding legal limits. The system includes an override function for situations involving potential bodily threat, with each override logged. Violations are considered misdemeanors with escalating fines ($1,000 for first offense, $5,000 for subsequent offenses), and the law preempts local regulations on PSE sales. Prescription-obtained PSE products are exempt from these restrictions, and retailers using the system in good faith are granted liability protection.
