This bill amends Chapter 149 of the Massachusetts General Laws by adding a new section (Section 52D) that provides legal protection for employers when providing employee references. Specifically, the bill creates absolute civil liability immunity for employers who disclose certain types of employment information about current or former employees to prospective employers. The protected information includes employment dates, pay levels, job descriptions and duties, and wage history. Additionally, when an employer responds in writing to a reference request, they are immune from civil liability if they share written employee evaluations conducted before the employee's separation and details about whether the employee's departure was voluntary or involuntary, including reasons for separation. The provisions of this bill will apply to legal causes of action that arise on or after the bill's effective date, effectively giving employers more confidence in providing honest and comprehensive employment references without fear of potential lawsuits.
