This bill introduces new regulations regarding the release of helium and other types of balloons in Massachusetts, aimed at reducing environmental harm. The legislation defines "intentional release" as knowingly releasing one or more balloons into the atmosphere and prohibits such releases, imposing civil penalties of at least $100 for the first violation, with additional $100 charges for every 10 balloons released. Subsequent violations will incur higher penalties of at least $500. The bill provides some exceptions, such as scientific balloon releases by government agencies, recoverable hot air balloons, and releases by children under 12 years old. Retail distributors will be required to post notices about the law's provisions in their stores and online sales platforms, and provide customers with information about the environmental impacts of balloon releases. The Department of Environmental Protection must prepare these notices in English and other languages spoken by at least 10% of the Massachusetts population. The law will take effect 90 days after its passage, giving businesses and individuals time to adapt to the new requirements and understand the potential environmental consequences of releasing balloons.
