This bill prohibits the sale of over-the-counter (nonprescription) medications containing dextromethorphan (DXM), a common cough suppressant, to individuals under 18 years old. If an employee or representative sells DXM to a minor, the first offense will result in a warning letter from the state Bureau of Health Care Safety and Quality, with subsequent violations leading to civil penalties of up to $150 for a second offense and $250 for third or subsequent offenses. Minors who attempt to purchase DXM can be fined $50. The bill specifically applies to nonprescription DXM products and does not restrict prescription medications containing the substance. Additionally, the law preempts any local ordinances regulating DXM sales, creating a uniform statewide standard.
