This bill modifies the MBTA (Massachusetts Bay Transportation Authority) Communities Act by providing additional ways for municipalities to remain eligible for state funding sources. Specifically, the bill offers three alternative paths for MBTA communities to maintain funding eligibility: (1) adopting zoning that allows for creating multifamily housing units 10% more than the total year-round units in the latest census, (2) producing housing units equal to at least 5% of total year-round units, or (3) creating housing through an approved housing production plan. The bill also changes language from "guidelines" to "regulations" regarding housing requirements and clarifies that these regulations cannot impose additional obligations beyond those specified. Furthermore, the bill establishes that a community will be considered compliant if multifamily housing units comprise at least 25% of its total year-round housing units. For the first four years after a new census, communities can use the preceding census data for calculation purposes. These modifications aim to provide more flexibility for municipalities in meeting housing development requirements while maintaining access to state funding sources.
