Specifically, the bill requires the DEP to publish a list of "toxic chemicals of concern" that includes carcinogens, endocrine disruptors, reproductive toxicants, and other hazardous substances, consulting multiple authoritative bodies like the EPA and International Agency for Research on Cancer. Manufacturers of children's products must notify the DEP if their products contain these chemicals above a minimal threshold, and for certain high-risk products (like those designed for children under 3 or those that can be placed in the mouth), manufacturers must eventually remove or substitute these chemicals. The bill also mandates that the DEP create a list of high-priority chemicals and potentially safer alternative chemicals, and requires manufacturers to conduct hazard assessments when substituting chemicals. Manufacturers can face civil penalties up to $5,000 for first offenses and $10,000 for repeat violations, and must recall products that violate the regulations. The DEP must submit a comprehensive report every three years detailing progress, challenges, and recommendations for addressing toxic chemicals in children's products.
